Terms of service

Last updated

These terms govern use of Trovewall by publishers, advertisers and anyone else with an account. Using the platform means accepting them.

1. Accounts

One account per legal entity. You are responsible for everything done with your credentials, including anything your API keys and postback secrets are used for. Tell us immediately if a key is exposed; rotate it yourself from the dashboard without waiting for us.

2. Publishers

  • Traffic must be genuine human users acting of their own accord. Incentivising completion with your own virtual currency is expected and fine; automating, simulating or misrepresenting completion is not.
  • You must not alter an offer's stated requirements, payout or disclaimer when presenting it.
  • You must credit your users for approved conversions and deduct for reversed ones.
  • Earnings from conversions later found to be fraudulent will be reversed, whether or not they have already been approved or withdrawn.

3. Advertisers

  • Offers must be lawful in every country they are targeted at, and the stated requirements must match what the user is actually asked to do.
  • Conversions must be reported promptly and accurately. Systematically under-reporting or reversing valid conversions is grounds for suspension.
  • Your wallet must hold cleared funds. Offers stop serving when it cannot cover a further conversion.
  • Reversals must have a genuine basis — fraud, a refund, or a failed qualification — and are available only inside the hold period.

4. Money

All amounts are in EUR. The publisher revenue share applicable at the moment a conversion is recorded is the one that applies to it. Payouts are made to a bank account in the account holder's own name once the minimum threshold is met.

We may withhold a payout while a conversion under it is being investigated. We will tell you that we are doing so and why.

5. Suspension and termination

We may suspend an account for suspected fraud, for breach of these terms, or where required by law. Suspension pauses serving immediately. Balances accrued from conversions that are not themselves fraudulent remain payable.

You may close your account at any time. Pending conversions complete their hold period first, and any remaining balance above the payout minimum is paid out.

6. Availability

We aim for continuous availability but do not guarantee it. Tracking and postback delivery are retried on failure; conversions are not lost to a temporary outage.

7. Liability

Trovewall's liability is limited to amounts held in your account balance. We are not liable for indirect or consequential loss, including lost revenue from an offer that was paused, depleted or reversed.

8. The other documents

These terms are the frame. The documents below sit inside it, apply to every account, and are part of the same agreement — where one of them covers a subject in more detail, the more detailed one governs:

9. Intellectual property

We own the platform, its software, its design and its marks. You are licensed to use them for as long as you have an account and for the purpose of using the service — nothing more. You own your own content, your own product and your own traffic, and you licence us only what we need in order to serve, measure and report on it.

Naming us as a partner is fine and encouraged. Implying we endorse, operate or guarantee your product is not; the boundary is drawn in the publisher advertising guidelines.

10. Confidentiality

Your figures are yours. We do not disclose an individual account's traffic, conversion rates, rates or balances to another customer, and aggregate statistics we publish never identify one account. In the other direction, non-public commercial terms we give you are not to be republished.

An advertiser's price for a conversion is never exposed to a publisher, and a publisher's share is never exposed to an advertiser. That is enforced in the software, not merely promised here.

11. Changes

We will give at least 30 days' notice by email of any change that materially reduces what you are paid or materially increases what you owe. Other changes take effect when published.

Every one of the documents in section 8 carries the date it last changed at the top. That date is edited when the text is, in the same release — it is not a timestamp of when the page was rendered, so it is worth something.

12. Governing law and disputes

This agreement is governed by the laws of the Republic of Seychelles, where Trovewall LLC. is registered, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. Nothing here removes a consumer protection right that cannot be waived where you live.

Before either of us starts proceedings, we should try to resolve it directly: write to [email protected] setting out the problem and what you want done about it. Most disputes on a network like this one turn out to be a reversal that needs explaining, and those are settled by looking at the records rather than by lawyers.

13. General

  • Assignment. You may not transfer your account or this agreement without our written consent. We may assign it to a successor of the business.
  • Severability. If a provision is unenforceable, the rest stands.
  • No waiver. Not enforcing something once does not give it up.
  • No partnership. Nothing here makes either of us the other's agent, employee or partner.
  • Entire agreement. These terms and the documents in section 8 are the whole of it, and replace anything said beforehand.
  • Notices. Ours reach you at the email address on your account; yours reach us at the address in the company details below.
